Charles
("Chuck") Birchall practiced corporate/commercial
and administrative law at McCarthy Tétrault from 1981
to 1986 before serving as Executive Assistant to the Honourable
Ian Scott when Mr. Scott was the Attorney General of Ontario.
After leaving Queen’s Park in 1989, Chuck returned
to McCarthy Tétrault to build a practice exclusively
in the area of environmental law, advising clients on environmental
and energy files involving the federal and Ontario governments.
In 1996, he launched his own environmental law firm, Birchall
Northey LLP. Chuck gained extensive experience in the environmental
compliance and assessment aspects of corporate commercial
negotiations and transactions, including assessment of contamination
issues, remediation, and approvals requirements. He also advised
on permits, environmental assessment and aboriginal consultation
issues respecting mining and oil and gas projects. Chuck has
appeared before various Parliamentary Committees in the House
of Commons and Senate on such legislation as the Canadian
Environmental Protection Act, the Canadian Environmental Assessment
Act, the Species at Risk Act, and the Yukon Environmental
and Socio-Economic Assessment Act.
In 2008, Birchall Northey LLP merged with the Municipal/Environment
Department of Fogler, Rubinoff LLP where he continues a legal
practice devoted to environmental and energy law, aboriginal
consultation, environmental assessment, and legal compliance.
Chuck holds a B.A. (Hons) from Trinity College, University
of Toronto, a LL.B. from Queen's University Faculty of Law
and a LL.M from the University of Ottawa, Faculty of Common
Law. He has also taught environmental law courses at various
times over the last 15 years. Most recently, he was an adjunct
professor at the University of Ottawa Faculty of Common Law
from 2006 to 2008.
Chuck is also Chair of the Canadian Arctic Resources Committee
and a past Chair of both the Canadian Council on Social Development
and the Canadian Environmental Law Association.
